The will of John Cutchey (Bury St Edmund’s RO)
In the name of God Amen I John Cutchey of Badwell Ash in the County of Suffolk farmer Do make this my last will and Testament in manner and form following (that is to say) first my Mind and Will is that all the Debts as shall be by me justly due and owing at the time of my decease whether by Bill Bond Note or other Contract whatsoever shall be paid satisfied and discharged out of my personal Estate and Effects And in case my personal Estate shall not be sufficient for that purpose then I subject and charge my real Estate with the payment thereof and Subject and chargeable therewith I give and devise all and every my Messuages or tenements farms lands Hereditaments and Premises such lying and being in Badwell Ash aforesaid and now in my own occupations And all other my real Estate within the Kingdom of England unto Bartholomew Mulliner the son of Susanna Kemball widow before Susanna Mulliner Spinster) my supposed natural son To hold the same and every part thereof unto the said Bartholomew Mulliner and to his heirs Executors Administrators and Assigns for ever charged and chargeable nevertheless and I do hereby subject and charge the said Messuages or tenements farms Lands Hereditaments and Real Estate and every or any part thereof with the payment thereout(?) of the following legacies (that is to say) I give unto John Bullemer the son of Job Bullemer of Eye in the said County farmer and Elizabeth his wife (before Elizabeth Cutchey my sister) the sum of two hundred pounds and I give unto Sukey Ann Kemp the wife of William Kemp of Carlton in the same county farmer (before Sukey Ann Bullemer the only daughter of the said Job Bullemer and Elizabeth his wife the like sum of two hundred Pounds And also I give unto Elizabeth Buttell(?) my present Housekeeper the sum of one hundred Pounds in case she shall be and continue on my service at the time of my decease but not otherwise All which several and respective legacies my Will and Mind is and I do hereby direct shall be paid to the said several and respective Legatees within twelve months next after my decease And in case of a nonpayment of the said several and respective legacies at the time aforesaid then I do hereby authorize and impower and it shall and may be lawful to and for the said legatees who shall be so unpaid to enter into and upon the said Messuages or tenements farms lands Hereditaments and real Estate aforesaid and every or any part or parcel thereof and the same to hold and enjoy and the Rents Issues and Profits thereof to receive and take unto full payment and satisfaction of the said several and respective legacies together with all costs charges and expences attending such entry or entries Also to Nominate Constitute and Appoint the said Bartholomew Mulliner and my Neighbour Mr William Rose(?) of Badwell Ash aforesaid Executors of this my last Will and Testament And I give unto the said William Rose the sum of five pounds for the trouble in the execution thereof Also all the rest residue and remainder of my personal Estate and Effects whatsoever and wheresoever and of what Nature Kind or Quality soever (after and subject to the payment of my just debts funeral and other expences and of the said Legacy to the said William Rose I give and bequeath the same and every part thereof unto the said Bartholomew Mulliner Also my Mind and Will is and I do hereby direct that my said Executors shall and do retain and deduct all their Costs Charges Damages and reasonable expences attending the Execution of this my Will out of the monies which will come to their hands by virtue thereof And that each of my said Executors shall be answerable for his own act and receipt only and not the one of them for the other of them In witness thereof I the said John Cutchey the testator have to this my last Will and Testament contained on two sheets of paper set my hand at the bottom of the first and my hand and seal to this second and last sheet the seventh day of May in the year of our Lord one thousand seven hundred and ninety five
