Thomas Chapman and cowboy builders!

Thomas Chapman was Sarah Chapman's uncle.  He was a solicitor in Margate, but also had a house in London, 19 Buckingham St (off the Strand)  When Thomas died in 1823, Sarah was his administratix.  Sarah was the wife of Edmund Bradley

Mr Peter UPSDELL and his Sureties to Mr Thomas CHAPMAN 

Dated 12th May 1809


Know all Men by these Presents that We Peter Upsdell of Castle Street Leicester Fields in the County Of Middlesex Surveyor James Hammon of Tottenham Street Fitzroy Square in the said County of Middlesex Painter and Glazier and Samuel Dunage of Saint Paul’s Church Yard in the City of London Trunk Maker are jointly and severally held and firmly bound to Thomas Chapman of Margate in the County of Kent Gentleman in the Penal Sum of Two hundred and forty Pounds of good and lawful Money of the United Kingdom of Great Britain and Ireland current in England To be paid to the said Thomas Chapman or his certain Attorney Executors Administratos or Assigns For which payment to be well and faithfully made We bind ourselves jointly and severally our and each of our Heirs Executors and Administrators and every of them firmly by these Presents sealed with our Seals. dated this twelfth Day of May in the forty ninth year of the Reign of our Sovereign Lord George the third by the Grace of God of the United Kingdom of Great Britain and Ireland King Defender of the Faith and in the year of our Lord One thousand eight hundred and nine.


Whereas the roof over certain Rooms or Chambers belonging to the above named Thomas Chapman and now in the occupation of William Young Esquire as his Tenant part of a Messuage or Tenement situate No 19 in Buckingham Street in the Strand in the said County of Middlesex being defective and out of repair the above bounden Peter Upsdell did some months back  contract and agree with the above named Thomas Chapman to repair the said Roof so as to make the same a sound light and durable Roof in all particulars at or for the Sum of one hundred and twenty pounds to be paid by the above named Thomas Chapman to the above bounden Peter Upsdell And whereas the above bounden Peter Upsdell proceeded to work upon the said Roof  put the same as he conceived into repair but the said Roof has since that time proved so defective as to admit the water in several places through the same into the apartment immediately beneath and the above named Thomas Chapman hath on account thereof declined to pay to the said Peter Upsdell the said Sum of One hundred and twenty pounds And whereas  the above bounden Peter Upsdell hath applied to and requested the said Thomas Chapman to advance and pay to him the said Sum of one hundred and twenty pounds he the said Peter Upsdell engaging forthwith at his own expence to put and place the said Roof in all particulars into a sound and durable state and condition and to indemnify and make good to the said Thomas Chapman his Heirs Executors Admins or Assigns all Sum and Sums of Money Losses Costs Charges Damages and Expences whatsoever which he or they shall or may lose sustain bear pay or expend in any way by reason or on Account of any defect in the said Roof and that the above bounden James Hammon and Samuel Dunage shall become sureties jointly with him the above bounden Peter Upsdell for all the above purposes  And whereas  upon the faith of the said proposal of the above bounden Peter Upsdell and of the security hereby given by him and by the said James Hammon and Samuel Dunage the above named Thomas Chapman hath on the day of the date of the above written Bond or Obligation paid to the said Peter Upsdell the whole of the said Sum of one hundred and twenty pounds as they the said Peter Upsdell James Hammon and Samuel Dunage doe hereby respectively admit and acknowledge  Now therefore the Condition  of the above written obligation is such that if the above bounden Peter Upsdell his Heirs Executors or Administrators some or one of them do and shall forthwith and without delay at his and their Costs Charges and Expence put and place the said Roof in every particular in a good sound perfect and Durable state of Repair And if the above bounden Peter Upsdell James Hammon and Samuel Dunage some or one of them their or some or one of their Heirs Executors or Administrators do and shall from time to time and at all times hereafter (words crossed out ‘ for the space of Twenty Years to be con???  from the date of the above written Obligation) repay and make good unto the above named Thomas Chapman his Executors Administrators or Assigns All such Sum and Sums of money for Rent or otherwise and all Losses Costs Charges Damages and expences whatsoever which to the said Thomas Chapman his Executors Administrators or Assigns shall or may lose bear sustain or expend for or by reason or on account of any defect in the said Roof in any way or to be occasioned by any such defect Then the above written obligation to be void otherwise to be and remain in full force and virtue.


Sealed and delivered by the above named parties (the words from “at all times hereafter’ to “repay and make good” being first obliterated and the Bond duly stamped in the presence of

Memorandum - That it was understood by all the parties above named that if the Roof above mentioned shall stand sound and perfect for the space of Five Years from this day that the above written Bond shall be delivered up to be cancelled - as Witness my Hand this 12th day of May 1809
